Privacy Policy

Siggins Aviation Consulting Pty Ltd in conjunction with Competency Solutions Pty Ltd is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal or Sensitive Information within TRACDsolutions TM.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (the Privacy Act). This Act governs the way in which we collect, use, disclose, store, secure and dispose of your Personal or Sensitive Information.

Overview

We collect, hold, use and disclose Personal and Sensitive Information for the purposes of maintaining training records to allow our users to meet the requirements of Civil Aviation Safety Regulations (1998) Part 61, Part 141 and Part 142.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that reasonably identifies an individual.

Examples of Personal Information we collect include: names, Aviation Reference Numbers (ARN), addresses, date of birth, email addresses, phone and facsimile numbers, aviation qualifications and experience.

This Personal Information is normally obtained from a third party (your training organisation). We will also obtain this information if you update your personal information directly through your personal log in to TRACDsolutions (TRACD).

We collect and store your Personal Information for the Primary Purpose of providing our services to you, specifically:

  • identification for training records as required by regulators i.e. CASA, ASQA, etc.
  • communication in regard to training; and
  • billing purposes

We may also use your Personal Information for a Secondary Purpose in circumstances where you would need to be contacted in regard to any changes to the software as well as any training in relation to the software. We may also use your personal information to contact you. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

 Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

The Sensitive Information that we obtain or record within TRACDsolutions is limited to items including, but not limited to:

  • Nationality and
  • English Language Level (as defined by CASA).

Third Parties

Where reasonable and practicable to do so, we will collect your Personal or Sensitive Information only from you. However, in most circumstances, we are provided with your personal information by third parties (your training provider) who obtain this information from you. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal or Sensitive Information

Your Personal or Sensitive Information may be disclosed in a number of circumstances including the following:

  • Third parties where you consent in writing (by email where we can confirm that the email comes from you, or letter signed by you) to the use or disclosure such as when you request your training records be provided to another training organisation; and
  • Where required or authorised by law. This includes providing your Personal or Sensitive Information along with your training records to CASA, the ATSB or other government agencies where this is required by law.

Security of Personal or Sensitive Information

Your Personal or Sensitive Information is collected and stored on third-party servers secured by SSL certificates and encryption that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal or Sensitive Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. Digital records of the Personal Information will be deleted but paper records of Personal Information will be retained for a period of 7 years and then destroyed.

Access to your Personal or Sensitive Information

You have the right to access the Personal or Sensitive Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your complete Personal Information, please contact your training provider or, if that is not possible, contact us in writing. You have the opportunity to update some of your Personal or Sensitive Information through your personal log on to the TRACDsolutions TM records web site.

If you require access to your Personal or Sensitive Information through Competency Solutions Pty Ltd, we will not charge any fee for your access request, but will charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal or Sensitive Information we will require identification from you before releasing the requested information.

This Policy operates alongside the Freedom of Information Act 1982 (Cth) and does not replace informal or legal procedures for the individual to request their Personal Information.

Maintaining the Quality of your Personal or Sensitive Information

It is an important to us that your Personal or Sensitive Information is up to date. We will take reasonable steps to make sure that your Personal or Sensitive Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise your training provider so that they can update your records or, if that is not possible, contact us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Data Breach

If we become aware that our data storage which contains your Personal or Sensitive Information has been breached, hacked, lost, stolen or has been accessed, disclosed or modified by unauthorised persons, we will:

  • Attempt to contain the breach
  • Assess the extent of the breach
  • Notify you and any relevant authorities of the event and our actions.
  • Review our security procedures.

This Policy may change from time to time and is available on our website at http://www.tracdsolutions.com.au./

Privacy Policy Breaches

In the event of a breach of this Policy you can file a complaint in writing to admin@sigginsaviationconsulting.com.au that we will respond to within 30 days from date of receipt of written complaint.

If you are unsatisfied with our response, you may have the option to seek available external dispute resolution. For example, complaints can also be taken to the Office of the Australian Information Commissioner (OAIC).
